Law Enforcement Guidelines

People trust DreamTrak with their inner lives. We respect lawful requests from authorities, and we ask for the proper legal process before we share anything about a member.

These guidelines are for law enforcement officers and government authorities. They aren’t legal advice, and they don’t create rights or obligations for anyone.

At a glance

Proper legal process

We disclose member data only when valid legal process requires it, or in a genuine emergency.

Members are told

We let members know about requests for their data, unless the law or a real risk prevents it.

Emergencies

An imminent risk to someone’s life or safety can justify sharing information without the usual process.

Diaries are encrypted

Diary text is encrypted inside the app before it’s saved.

03

Emergency requests

In short

If someone’s life or safety is in immediate danger, we may share information without the usual process.

Where there’s an imminent risk of death or serious physical injury, we may disclose information to a government authority voluntarily, case by case and as the law allows, if we believe in good faith that it’s needed to prevent the harm. Send emergency requests to our legal team with the subject line “EMERGENCY REQUEST”. We can’t promise a response time. Emergency requests are handled by the staff on duty during business hours.

04

Telling members

In short

We tell members about requests for their data before we disclose it, unless the law forbids it or telling them would put someone at risk.

Our practice is to notify members of requests for their data before disclosure, so they can challenge the request. We won’t do so where the law prohibits it, or where we believe in good faith that notice would put someone at risk of harm or compromise an investigation, for example by risking the destruction of evidence. Where a non-disclosure order applies, we notify once it ends.

05

Preserving data

In short

We can preserve an account’s data for 90 days, renewable once, while you obtain the right legal process.

We honour formal preservation requests. Preservation doesn’t mean disclosure: it keeps the named account’s existing data from being deleted for 90 days, which can be extended once, while the appropriate legal process is obtained.

06

How to send a request

In short

By email to our legal team, on official letterhead, naming the account and the records you need.

We accept legal process by email to . We don’t accept it through social media, community posts or in-app messages. Please include:

  • the full name of the requesting agency, and contact details for the officer issuing the request;
  • a signed copy of the legal document on official letterhead;
  • the account concerned, identified by the member’s email address or DreamTrak account ID; and
  • a specific, narrow description of the records sought, and the time period they cover.

Where the law allows, we may ask for reasonable costs of responding to be reimbursed.
